News Release

Burglary 1 / Criminal Mischief / Violation Court Order -09/29/21

Location:               908 NE Fogarty St, Newport

Date/Time:             September 28th, 2021 @ 1730 Hours

Arrested:               Adin Byron KIMBALL, 29yoa, NEWPORT, OR

Details: On September 28th, 2021, at about 10:00am, the Lincoln County Sheriff’s Office Tactical team served a Writ of eviction on KIMMBALL at 908 NE Fogarty Street, Newport, Oregon. KIMBALL had made previous threats of harm prior to this event leading to the use of the tactical team to remove KIMBALL from the residence. Kimball left the residence without incident.

At about 5:30p.m., the Newport Police Department was advised that KIMBALL was back at the residence and several witnesses observed Kimball break back into the residence.

Newport officers arrived and attempted contact with KIMBALL inside the residence. Officers could hear someone inside the residence and witnesses positively identified KIMBALL as the person who had entered the residence.

After about 10 minutes of knocking and announcing, KIMBALL opened the front door and began a heated dialogue with Officers. KIMBALL was not compliant and advised officers he was within his rights to be at the residence (despite the writ served to him from the courts earlier in the day ordering him to vacate the premises). KIMBALL retreated back into the residence and reappeared outside brandishing a claw hammer in his hand.

Newport Officers began talking to KIMBALL, who was now standing in the driveway of the residence, trying to get him to drop the weapon and to surrender. KIMBALL refused to comply and a requested was made for additional Officers. The Lincoln County Sheriffs’ Office patrol deputies and a K9 unit arrived to assist. After a few more minutes of talking with KIMBALL, he decided to drop the hammer and surrender without incident.

KIMBALL was taken into custody and lodged at the Lincoln County Jail for the following charges; Burglary 1, Criminal Trespass 1, Criminal Mischief 2, Theft of Services, and Violation of a Court Order.
