DA Mike Schmidt announces 10 people charged following civil unrest incidents

PORTLAND, Ore. – Today, Multnomah County District Attorney Mike Schmidt announced that 10 people have been charged with various felony crimes that occurred during three separate incidents of civil unrest.


Incident Date: November 08, 2020

Maximilian Jennings, James Prettyman and Thomas Moll-Rocek are all charged with one count of Riot, one count of Criminal Mischief in the First Degree and one count of Criminal Mischief in the Second Degree.

All three are accused of causing property damage on November 08, 2020 to the Multnomah County Democrats’ headquarters, located in the 3500 block of Northeast Sandy Boulevard in Portland. The damage is estimated to be more than $1,000.

All three cases have been reinstated by the State of Oregon after law enforcement completed the necessary and requested investigative follow-up.


Incident Date: January 20, 2021

Kai-Ave Douvia is charged with one count of Riot, one count of Criminal Mischief in the First Degree and two counts of Criminal Mischief in the Second Degree.

Austin Nuchraksa is charged with one count of Riot, one count of Criminal Mischief in the First Degree, one count of Criminal Mischief in the Second Degree and four counts of Unlawful Possession of a Destructive Device.

Nicole Rose, Darrell Kimberlin, Jean Paris and Kyle Romstad are all charged with one count of Riot, one count of Criminal Mischief in the First Degree and one count of Criminal Mischief in the Second Degree.

All six are accused of causing property damage on January 20, 2021 to the Democratic Party of Oregon building, located in the 200 block of Northeast 9th Avenue in Portland. The damage is estimated to be more than $1,000.

Nuchraksa is further accused of knowingly possessing four destructive devices.

Douvia is further accused of causing property damage at a Starbucks on November 02, 2020.


Incident Date: April 23, 2021

Sean Lopez is charged with one count of Attempted Assault in the Second Degree, one count of Burglary in the First Degree, one count of Unlawful Use of a Weapon and two counts of Criminal Mischief in the First Degree.

Lopez is accused of throwing a rock through a window at a coffee shop located in the 1300 block of Northwest 23rd Avenue in Portland.

Lopez is also accused of throwing a rock at someone who was standing in an apartment complex window using a cellphone to record potential criminal activity on that same date. The rock Lopez threw broke the window and nearly struck the victim, records state. The incident caused damage to the window, ceiling and wall, according to court documents.

Portland Police arrested Lopez on May 29, 2021 after being located at a demonstration in downtown.


The Multnomah County District Attorney’s Office continues to work with and assist the Portland Police Bureau to ensure all investigative leads are exhausted on these civil unrest cases and to ensure that the police reports and evidence submitted to our office are complete for prosecutorial screening.

A charging document is only an accusation of a crime. Jennings, Prettyman, Moll-Rocek, Douvia, Nuchraksa, Rose, Kimberlin, Paris, Romstad and Lopez are all innocent unless and until proven guilty.
