Superseding indictment filed against a 30-year-old man accused of raping or sexually assaulting 12 women
Today, Multnomah County District Attorney Rod Underhill announced the filing of a 35-count superseding indictment against 30-year-old Rafael Gustavo Alcon-Ayala who is accused of raping or sexually assaulting a total of 12 women between 2010 and 2019.
In January of 2020, the Multnomah County District Attorney’s Office, working with the Portland Police Bureau and Gresham Police Department, requested assistance from the public after Alcon-Ayala’s arrest.
Following that press release, law enforcement received additional reports, which led to the re-indictment.
Alcon-Ayala is now charged with 16 counts of rape in the first degree, one count of strangulation, one count of unlawful sexual penetration in the first degree, 12 counts of sexual abuse in the first degree, one count of attempted unlawful sexual penetration in the first degree, one count of delivery of oxycodone, one count of unlawful possession of oxycodone, one count of delivery of 3,4-methylendedioxymethamphetamine (commonly known as ecstasy), and one count of unlawful possession of 3,4-methylendedioxymethamphetamine.
The indictment alleges Alcon-Ayala unlawfully and knowingly used force to rape or sexually assault the victims who, at the time, were incapable of consent either by reason of physical helplessness or mental incapacitation. Alcon-Ayala is also accused of unlawfully and knowingly impeding the normal breathing and blood circulation of one of the victims.
The crimes alleged in the indictment occurred between July of 2010 and July of 2019 in Multnomah County.
All of the victims identified in the indictment are requesting privacy. The Multnomah County District Attorney’s Office is requesting that media refrain from attempting to or actually contacting them.
This case is being investigated jointly by the Portland Police Bureau’s Sex Crime Unit and the Gresham Police Department.
Like in all criminal and civil matters, electronic copies of court documents, which are not subject to a protective order, are available to the public through the Oregon eCourt Information (OECI) system.
No additional information can be released by the Multnomah County District Attorney’s Office at this time pursuant to the Oregon Rules of Professional Conduct.
A charging document is only an accusation of a crime. Alcon-Ayala is innocent unless and until proven guilty.
