Indictment filed in July 28, 2019 assault and homicide

Today, Multnomah County District Attorney Rod Underhill announced the filing of an indictment against a father and son for the alleged assault and subsequent homicide of 25-year-old Tylone Tolliver.

Horace Atchison, 46, is charged with one count of murder with a firearm, one count of assault in the second degree and one count of assault in the third degree. According to the indictment, he intentionally, while using a firearm, caused the death of Mr. Tolliver.

Demetrius Atchison, 26, is charged with one of assault in the second degree and one count of assault in the third degree. 

This investigation started on July 28, 2019 when officers assigned to the Portland Police Bureau responded to a disturbance and shooting near the intersection of Northeast Russell Street and Northeast Rodney Avenue in Portland, Oregon.

When officers arrived, they located Mr. Tolliver lying on the ground with a gunshot wound. Medical crews responded, but he died on scene.

On August 7, 2019, a court-authorized arrest warrant was issued for Horace Atchison. Law enforcement located and arrested Atchison in King County, Washington. He was extradited to Oregon and subsequently booked into the Multnomah County Detention Center on September 3, 2019.

Demetrius Atchison was arrested August 27, 2019 and booked into the Multnomah County Detention Center on a probation violation detainer.

The arrest warrant affidavit in this case for Horace Atchison remains sealed.

No additional information can be released by the Multnomah County District Attorney’s Office at this time pursuant to the Oregon State Professional Rules of Conduct.

A charging document is only an accusation of a crime. Both Horace Atchison and Demetrius Atchison are innocent unless and until proven guilty.
