Grand jury returns secret indictment against Donovan Flippo and Tusitala Toese - 03/12/19

Grand jury returns secret indictment against Donovan Flippo and Tusitala Toese

Today, Multnomah County District Attorney Rod Underhill announced that the secret indictment charging 23-year-old Donovan Flippo and 22-year-old Tusitala Toese with assault has been unsealed.

The three count indictment was filed on February 28, 2019 and was made publicly available by the court on March 12, 2019 after Flippo was booked into the Multnomah County Detention Center.

Count one of the indictment charges Toese and Flippo with assault in the third degree for unlawfully, intentionally and knowingly, while being aided by each other, causing physical injury to another person.

Counts two and three of the indictment charges both men, individually, with assault in the fourth degree for unlawfully, intentionally, knowingly and recklessly causing physical injury to another person.

The alleged assault happened in Multnomah County on June 8, 2018.

Flippo is scheduled to be arraigned on the indictment on March 13, 2019 at 9:45 a.m. in Courtroom number three at the Multnomah County Justice Center.

While Toese is named in the same indictment as Flippo, he has not been arrested.

An indictment is only an accusation of a crime. Both Toese and Flippo are innocent unless and until proven guilty.

This remains an ongoing investigation and as such, no additional information can be released by the Multnomah County District Attorney’s Office.

A copy of the indictment filed can be obtained using the Oregon eCourt Information (OECI) system under case number 18CR43659.

This case is being litigated by the Multnomah County District Attorney’s Office Strategic Prosecution Unit, which reviews cases that stem from neighborhood-specific concerns. The unit is primarily responsible for interfacing with the community over specific issues, and handles all types of cases across the criminal justice spectrum to include misdemeanors and homicides.
