Former Milwaukie Police Officer Faces Criminal Charge Related To Official Misconduct (Photo) - 05/12/23
On May 10, 2023, the Milwaukie Police Department was informed that the Clackamas County District Attorney’s Office has charged a former Milwaukie Police Department Officer, David McVeigh, with Official Misconduct in the First Degree (ORS 162.415) based on incidents that are alleged to have occurred while he was on duty. ORS 162.415 – Official Misconduct in the first-degree states:
- A public servant commits the crime of official misconduct in the first degree if: (a) With intent to obtain a benefit or to harm another: (A) the public servant knowingly fails to perform a duty imposed upon the public servant by law or one clearly inherent in the nature of the office; Or (B) The public servant knowingly performs an act constituting an unauthorized exercise in official duties. Official misconduct in the first degree is a Class A misdemeanor.
We can confirm that Mr. McVeigh worked for the Milwaukie Police Department starting in March 2016 and was terminated in March 2023. As soon as the Police Department learned of these allegations, we turned the matter over to the Clackamas County Sheriff’s Office for an independent criminal investigation. Milwaukie Police Chief Luke Strait expressed: “I would like to thank the complainant for speaking out and thank the Clackamas County Sheriff’s Office for investigating this matter, seeking truth and justice.”
The Milwaukie Police Department recognizes the incredible importance of the authority bestowed upon its police officers and understands that allegations of this nature can call into question the public trust for this essential service. We are committed to addressing any abuse of power or authority for personal gain as a very serious breach of public trust and a violation of criminal law.
