61-Year-Old South Beach Man Sentenced To Life In Prison After Third Strike Felony Sex Crime Conviction (Photo)

On September 22, 2026, Lincoln County Circuit Court Judge Amanda Benjamin sentenced Herman Walter Graham (61-year-old) to life in prison for the repeated sexual abuse of a 16-year-old family member. After a three-day jury trial, Graham was found guilty of four counts of Sexual Abuse in the Third Degree and one count of Sexual Abuse in the Second Degree.
Graham’s criminal history prior to trial was disturbing. Graham had nine (9) prior felony convictions for Sexual Abuse in the First Degree from 1997 and 2001; convictions that stemmed from the repeated sexual abuse of two children in Graham’s immediate family. Under Oregon Law, if a defendant has been convicted of sex crimes two times prior to the current offense, the presumptive sentence is life imprisonment without the possibility of release or parole, unless the sentencing judge finds substantial and compelling reasons to impose a lesser sentence.
At sentencing, Graham requested a lighter sentence, arguing that a life sentence was unduly harsh. However, Judge Benjamin sentenced Graham to life imprisonment without the possibility of parole. Judge Benjamin specifically addressed the victim stating, “Your voice was heard and it was believed clearly through the verdicts of the jury. Your voice prevented further victims and more abuse from happening.”
This case was prosecuted by District Attorney Jenna Wallace and investigated by the Benton County Sheriff’s Office and Lincoln County Sheriff’s Office.
