House Bill 2618 Increases Civil Service Fees Jan 1 - 12/04/17

NARRATIVE:

House Bill 2618 was signed into law by Governor Kate Brown on June 20, 2017 and will take effect January 1, 2018. This Bill increases the fees (under ORS 21.300) for service of papers by the Sheriffs and includes language that the earliest the fees could increase again would be July1, 2021 depending on cost of living increase. Last time civil fees were increased was in 2009. At that time the fee for service of a small claim or summons & complaint went from $28 to $36 ($8.00 increase). See fee increase schedule below:

For Small Claims, Summons and Complaint/Petition, F.E.D. Summons/Complaint, Notice of Restitution, Civil Subpoena, or any notice process not mentioned herein, follow the schedule below. (For process service over 75 miles roundtrip, the fees are an additional $45.00)

Publication fees for sales are not included, the newspaper determines this amount. Additional fees for actual cost of postage and copying apply to most executions)

Restraining Orders/Protective Orders No Charge
Copying $.25 per page /$3.00 per folio
Postage - Actual Cost
Certificate of Sale and Deed $50.00
Notary: $10 (for Sheriff certificate of sale, Sheriff's deed or out of state process which requires a notarized affidavit of service). This office does not perform notarial services for the general public.
