Public notice and request for comment on 1915 (c) #40193, #40194, and #0565 waiver amendments - 07/06/18

The Oregon Department of Human Services’ Office of Developmental Disabilities Services is seeking public comment regarding the 1915 (c) #40193 Medically Fragile Waiver, #40194 Behavioral Waiver, and #0565 Medically Involved Waiver amendments.

The waiver amendments are requesting to:

#40193 Medically Fragile Waiver:

• Add the Medicaid eligibility group §435.145;

• Add state-trained assessors as the person completing the functional needs assessment and level-of-care determination;

• Increase unduplicated number of participants to 120;

• Appendix C – Case Management – add language about the case manager collaborating with the state-trained assessor;

• Appendix C – Family Training – remove the following language, “Counseling must be aimed at assisting the unpaid family members providing supports, training, companionship and/or supervision in meeting the needs of the participant and assist the family with the stresses associated with caring for an individual with disabilities” as this is old language;

• Appendix G – add restraint language to align with other ODDS 1915(c) waivers;

• Revise QIS and performance measures to reflect ODDS QA Unit performing reviews and keeping performance measures consistent with other waivers;

• Technical changes to clean up language throughout the application.

#40194 Behavioral Waiver:

• Add the Medicaid eligibility group §435.145;

• Appendix B – Align level of care requirements with federal standard by consolidating 12 areas of functional deficit to six;

• Add state-trained assessors as the person completing the functional needs assessment and level-of-care determination;

• Increase unduplicated number of participants from 160 to 200 for waiver year 5;

• Appendix C – Case Management – add language regarding the case manager collaborating with the state-trained assessor;

• Appendix C – Family Training – remove the following language, “Counseling must be aimed at assisting the unpaid family members providing supports, training, companionship and/or supervision in meeting the needs of the participant and assist the family with the stresses associated with caring for an individual with disabilities”;

• Appendix G – add restraint language to align with other ODDS 1915(c) waivers;

• Revise QIS and performance measures to reflect ODDS QA Unit performing reviews and keeping performance measures consistent with other waivers;

• Technical changes to clean up language throughout the application to be consistent with other waivers.

 

#0565 Medically Involved Waiver:

• Add the Medicaid eligibility group §435.145;

• Add state-trained assessors as the person completing the functional needs assessment and level-of-care determination;

• Increase unduplicated number of participants to 225 for waiver years 3, 4 and 5;

• Appendix B – Remove priority #3, Children residing in the community who are at imminent risk of NF placement, from the Selection of Entrants to the Waiver; remove reserved waiver capacity as the criteria is the same as appendix B-3-f Selection of Entrants to the Waiver;

• Appendix C – Case Management – add language regarding the case manager collaborating with the state-trained assessor;

• Appendix C – Family Training - technical change to make definition consistent with other waivers;

• Appendix G – add restraint language to align with other ODDS 1915(c) waivers;

• Revise QIS and performance measures to reflect ODDS QA Unit performing reviews and keeping performance measures consistent with other waivers;

• Technical changes to clean up language throughout the application to be consistent with other waivers.
